Know Your Family and Medical Leave Act Rights

Federal law requires employers to provide leave for employees under certain conditions as established by the Family and Medical Leave Act and Nevada is not excluded from this rule. Who is Covered by the FMLA?

The FMLA covers the employees of all organization under federal, state, and local management. The FMLA also covers any employee of a private business that employs more than 50 people and where that specific employee has worked at the company for more than 20 weeks. Should the leave be due to illness, either for the employee themselves or their family member, 12 weeks of leave is allotted within a 12 month period. There is no limit to the number of times an employee can utilize the leave provided it does not exceed 12 weeks in a single 12 month period. The employee can also break up the leave into non-consecutive periods (such as for periodic medical appointments) provided it follows the time regulations already stated. Employers can request that employees use their accrued paid leave during this leave.

If An Employer Has Denied Family Leave

Not only is an employer is supposed to honor the leave as stated above, an employee is supposed to reinstated at the same position or equivalent barring extraordinary exceptions. Should an employer negatively interfere with an employee’s right to family leave, that employer is liable in a lawsuit.
