Sunrise Hospital in Las Vegas fired a nurse last year when a drug test revealed that he tested positive for marijuana. In a lawsuit against the hospital, Scott Nellis won a preliminary victory in his wrongful termination case. This case could determine if Nevada employment law is keeping pace with the increasing public acceptance of cannabis.

Judge Mark Bailus, a Clark County District Court has denied the motion filed by the hospital to dismiss the lawsuit on all but one of five counts.

The Sunrise spokeswoman, Fran Jacques, defended their position saying  “Backed by our mission to surround our patients with caregivers who are dedicated to healing above all else, we strongly believe we acted appropriately and we are prepared to vigorously defend ourselves in this case.”

Gabroy Law Offices, who represents Nellis has said that he hopes to take it to a jury trial and the Supreme Court to set precedent.

“This is a fight that I’ve been looking forward to for quite some time. It’s amazing. It’s a new civil right of the 21st century,” said attorney Christian Gabroy.
